12/18/2003 Archived Entry: "U.S. Govt Legalizes Spam, Syria Supplying al-Qaida with Weapons, bondage mummification, Iraqi porn sites, Britney Spears bound by saran wrap, teeth fetish pics"
I worked last night until 4:30 this morning, so I got a late start today. About all I accomplished today was to sort out the porn pictures to use to update three websites (out of nine due this week). Stuff in my email this morning that required attention took me until late afternoon. I ate lunch at my desk and didn't break for dinner until 9:00. It's looking like another late night for me.
Spammers around the world are celebrating the new Can-Spam law that President Bush has just signed, making email spam legal in the U.S. The new law will go into effect January 1st and will pre-empt more restrictive laws passed in individual States like California. I read some of the spammer message boards to see how they were reacting to the passage of the law, and they’re filled with glee. In the past, they’ve had to resort to sending out spam through proxy servers and spoofing the header information to get around the spam-blocking methods most internet providers use to prevent their customers from receiving excessive spam. Under the new law, that will no longer be necessary for them because it legitimizes spam that follows the law’s guidelines. Now the spammers can file lawsuits against the organizations that block their mailings from getting through to the intended recipients on the grounds that those organizations are intentionally doing harm to a business following legitimate business practices. Although the lawmakers are presenting the new law as a “landmark anti-spam bill,” it’s fairly obvious that it was written by people with no real clue about how things work.
I think there’s even a chance I could make some money from this law, although I’ve never been a spammer. I know that at least one of the biggest spam-blocking organizations, spamhaus.org, has my entire range of IP addresses blocked, dating from a time previous to when I was assigned those addresses. Any email I send out from any of those domains is automatically blocked by any ISPs that use the spamhaus blacklist. Since any of my mailings are fully compliant with the new Can-Spam law, I should be able to file lawsuits against Spamhaus and each of the ISPs which are Spamhaus customers for blocking my legal mailings from reaching the people who have signed up to receive them. I can probably make a good living for a few years just off settlement payments.
