12/24/2005 Archived Entry: "Germans Exchange Terrorist for Hostage, Patriot Act Contains Frightening Powers, Religious Groups Hold Up Relief for Gulf Coast, Website Owner Held Without Bail for Speech U.S. Gov't Doesn't Like, Today's New Adult Links"
A couple of weeks ago, I transported a slave 1000 miles to new owners in Tulsa. It was an eighteen hour drive and she never stopped talking. How is it possible to do that? I only speak when I have something to communicate. She said nothing during the whole trip that I can recall now. I did not encourage her in any way. I think I grunted once in a while. When I dropped her off, I didn't socialize with her new owners at all, couldn't get away fast enough. I took my time driving home and spent three days on the road in wonderful solitude. Her new master called me tonight to complain about her. I guess he should have gotten a clue when I was willing to drive 1000 miles to get rid of her. If he'd asked me the right questions beforehand, she'd probably still be here.
The "get paid to surf" program that I'm in paid me another $2400 last night. That was three days ahead of schedule, so I'll take that as an indication that the program is still going strong.
The German archaeologist kidnapped in Iraq last month was released after Germany agree to release a Hizballah terrorist from prison. The terrorist was Mohammad Ali Hammadi, wanted in America, and sentenced to life without parole for the hijacking of an airliner and the murder of an American soldier on that flight. A US extradition warrant was on file in Berlin with a promise it would take effect if the hijacker were ever released. A few days after the terrorist was flown to Beirut, Osthoff (the archaeologist) was freed by her Iraqi insurgent captors. Realistically, the exchange serves two purposes. It's a slap in the face to America from Germany, and it sends a message to the terrorists that German citizens are a good target for kidnappers.
The Patriot Act is totally scary. Under it, the FBI can use National Security Letters (NSLs) to obtain information about citizens' bank accounts, credit card purchases, reading materials, apartment/office leases, driver's licenses, telephone use, e-mail use, instant message use and Web surfing, all of which must be provided, under the Act, without the provider ever telling the target of the investigation that the information was sought or provided. Over 30,000 NSLs were issued last year, with just one having been challenged in court by its recipient, a library in Connecticut, as violative of its patron's constitutional rights. That means that as to the 29,999 other such letters, information was provided without official question. The Act also authorizes police and federal personnel to conduct secret searches of citizens' homes and businesses without any prior or subsequent notification to the target. The effects of these policies on the Constitution's Fourth Amendment protections are devastating. The New York Times reported on Dec. 10, "newly disclosed FBI e-mail messages which show that, privately, some FBI agents have felt hamstrung by their inability to get approval for using new powers under the Patriot Act" and that they welcomed changes being made to the Act that would "allow the bureau to 'bypass' the department's intelligence office, which normally reviews all such requests." Bypass the intelligence office? We were told that the Patriot Act was about fighting terrorism. If the FBI is using it for that purpose, why would they feel any need to bypass the intelligence office?
New changes to the Patriot Act make it clear that the sweeping powers given to the executive branch of the government are intended to be used much more widely than just for fighting terrorism. For instance, the new Act increases the penalty for distribution of methamphetamines to a minor to 20 years for a first offense, and reduces the number of contraband cigarettes that qualifies as a federal crime from 60,000 to 10,000 – neither of which changes can arguably be said to have anything to do with combatting terrorism. You can read more on this at this page. Personally, I am more scared of a government with these kinds of "police state" powers than I am of the terrorists. Is the loss of our civil rights and our privacy the cost we have to pay to stop the occasional terrorist attack? Doesn't seem worth it to me...
The American Family Association (AFA) has begun a petition drive to urge the U.S. Senate to discriminate against, among others, massage parlors and adult bookstores which, along with thousands of other businesses, would be eligible for a federal tax relief package to offset the effects of the recent Gulf Coast hurricanes. "Congress is being asked to give nearly a half-billion dollars in tax credit to casinos, country clubs, liquor stores, massage parlors, adult bookstores and 'escort' services which were damaged by hurricanes Katrina and Rita," the AFA petition reads. "The House version doesn't allow tax breaks for casinos, country clubs, liquor stores and massage parlors while the Senate version does. Send an email to your U.S. Senators and urge them not to include casinos, country clubs, liquor stores, massage parlors, adult bookstores and 'escort' services in the half-billion in tax credits."
On Dec. 8, the Family Research Council (FRC) hailed certain ultraconservative House Republicans for managing to exclude "private or commercial golf courses, country clubs, massage parlors, hot tub facilities, suntan facilities, liquor stores and racetracks or other facilities used for gambling" from the House tax relief bill, and it seems likely that FRC and several other fundamentalist religious groups will be urging, along with the AFA, that the Senate exclude these businesses as well. "These corporations have never had favorable tax treatment in the past and they should not get it now," announced FRC president Tony Perkins in boldface on FRC's website. But the adult businesses (and likely the others) aren't asking for "favorable" tax treatment; just equitable treatment, the same as any other affected legal business. "The root issue is rebuilding the economy of the devastated Gulf Coast, not catering tax benefits to companies that have a proven negative economic effect on even flourishing economies," Perkins continued. That's sort of deceitful. As a matter of actual fact, liquor stores, racetracks, casinos and even suntan facilities, hot tub facilities and massage parlors contribute plenty of revenue to the local economy, not to mention provide employment even in bad economic times like these. "Proven negative economic effect?" The reality is just the opposite.
If such discrimination makes it into the finished law, the affected companies could easily sue, which might hold up the federal aid for months or even years – a situation that Congress would likely want to avoid, and could easily do so by simply providing the tax breaks without regard for the type of business being helped. As usual, though, I don't think the religious organizations really expect to win on this issue. Any issue like this just provides free publicity to scam some more money out of their flocks. After all, it's really only the Gulf Coast that will suffer if tax relief is held up for years in court.
The owner of a website that posted pictures from the war in Iraq is being held without bail on obscenity charges. His bail was revoked because he continued to operate the website while waiting for his trial to see if he violated any law. So, he's out $151,000 in bail money, and he won't be home for the holidays. Let this be a lesson to those of us who like to exercise our free speech rights. If the government doesn't like what you're saying, they'll find something to charge you with, to shut you up. If you continue to say it while you're awaiting trial to find out if there's any validity to the charges, they'll put you back in jail until whatever year your trial comes up. We must all be very careful not to offend the government.
